Terms of Service
The rules. He read them so you don't have to. (Please read them.)
Last updated: November 5, 2026
1. The deal
These terms are an agreement between you and Lightbulb Moment Labs, Inc. (“we,” “us”) for the Penguin app (“the app”) and this website. By using either, you agree to these terms. If you don't agree, please don't use them. These terms add to Apple's Licensed Application End User License Agreement. If the two conflict, Apple's agreement wins.
2. Your license
We give you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, for your own non-commercial use.
3. Not medical advice
The app is a game about walking. Your daily goal is a game target, not a health prescription. Nothing in the app is medical advice. Talk to a doctor before starting a new activity routine, and stop if something hurts. Step counts come from Apple Health and your device's sensors and may not be perfectly accurate.
4. Waddles and pokes
Waddles let you share progress with people you invite. Be decent. Don't use the app to harass anyone, don't spam pokes, and don't give your penguin a name that's hateful, sexual, or meant to hurt someone. You're responsible for who you invite and what you send. We may limit features for people who abuse them.
5. Purchases
The app may offer optional purchases, such as Penguin Plus, that unlock cosmetic extras. Purchases are made through Apple, billed by Apple, and covered by Apple's terms and refund policies. If a purchase is a subscription, it renews automatically until you cancel it in your Apple ID settings at least 24 hours before the renewal date. Cosmetic items never change your progress.
6. Things you can't do
- Copy, modify, resell, or redistribute the app or its art.
- Reverse engineer the app, except where the law allows it.
- Interfere with the app, iCloud, or other people's use of either.
- Use the app for anything illegal.
7. Our stuff
The penguin, his art, his lines, and the app are ours and are protected by intellectual property laws. Screenshots for personal sharing are welcome. Honestly, that's the point.
8. Changes and availability
We may change, add, or remove features, and we may stop offering the app. We'll try to give notice of big changes, but we can't promise the app will always be available or error-free.
9. Disclaimers
The app and website are provided “as is” and “as available,” without warranties of any kind, to the fullest extent the law allows. That includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits. Our total liability for any claim about the app or website is limited to the greater of the amount you paid us for the app in the 12 months before the claim or US$10. Some places don't allow these limits, so they may not apply to you.
11. Ending things
You can stop using the app anytime by deleting it. We may end your license if you break these terms. Sections 3, 7, 9, 10, and 12 survive.
12. Governing law
These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules, except where your local consumer protection law says otherwise.
13. Changes to these terms
We may update these terms. We'll change the date at the top, and if the change is significant, we'll note it in the app or on this site. Continuing to use the app means you accept the updated terms.
